Recordkeeping Rule has Impacts for Drug Testing, Safety Incentive Programs

OSHA’s new Final Rule requiring electronic reporting of injury data was announced in May of this year. In addition to improving the tracking of workplace injuries and illnesses, the Final Rule also strengthens anti-retaliation measures in a way that may have big consequences for both drug testing policies and workplace safety incentive programs. Specifically, OSHA will be cracking down on drug testing it perceives as being used to punish workers or disincentivize them from reporting, and it will also be keeping an eye on incentive programs that are so generous they may lead workers to fail to report injuries or illnesses.
