OSHA Proposes New Recordkeeping Deadline for Electronically Submitting Injury, Illness Reports

Yesterday, OSHA announced a proposed delay of the electronic reporting compliance date of its rule, Improve Tracking of Workplace Injuries and Illnesses. By moving the compliance date from July 1, 2017, to December 1, 2017, the agency has an opportunity to further review and consider the rule.

Official news of the proposed delay follows an announcement made by OSHA last month of its intent to postpone the July 2017 deadline by which certain employers would have been required to submit the completed 2017 Form 300A Summary of Work-Related Injuries and Illnesses. According to OSHA, the delay will “provide the new administration an opportunity to review the new electronic reporting requirements prior to their implementation.”

OSHA’s announcement also indicated the electronic reporting system will be available starting August 1, which according to the National Law Review is an indication that the agency does intend to move forward with its implementation of the rule. OSHA points to the delay as also allowing those affected by the changes additional time to familiarize themselves with this new electronic reporting system.

Non-exempt employers with 10 or more employees are required to post a summary of injuries and illnesses from the previous year in a facility location clearly visible to employees and new applicants from February 1 through April 30 of each year. Under the new rule, certain employers are also required to electronically submit the information from their completed Form 300A each year.
